User Content & Marketplace Terms

These Terms are a legal agreement between you and MapX LLC (“MapX,” “mapx,” “we,” “us”). They cover your use of the marketplace, the files and designs you upload, team and shared accounts, purchases, order proofs, and user-generated and community-contributed content on mapx. By creating an account, uploading content, listing an item, ordering a product, or contributing mapping data, you agree to the terms below.
⚠ Placeholder terms — pending legal review. This document is provided as a working draft to describe how mapx handles content, teams, purchases, and proofs. It has not been reviewed or approved by a licensed attorney and does not constitute legal advice. Sections, defined terms, fee figures, jurisdiction, dispute-resolution, warranty, and liability language must be reviewed and finalized by qualified legal counsel before mapx relies on it as a binding agreement.
User Ownership
You retain ownership of any maps, artwork, sonar logs, bathymetry, GPS tracks, photographs, templates, or other content you upload to mapx.
License Granted to mapx
By uploading content, you grant mapx a worldwide, non-exclusive, royalty-free license to:
- Store your uploaded files.
- Display your content within the mapx platform.
- Process uploaded files into derivative map products such as contours, bathymetry, previews, thumbnails, SVGs, PNGs, vector files, and other formats required for the platform.
- Use anonymized or aggregated data to improve mapping quality, search, and platform functionality.
- Backup and archive uploaded content.
This license continues only while your content remains on mapx, except where copies must be retained for legal, security, backup, or completed customer transactions.
Teams & Shared Accounts
mapx lets you create or join a team to collaborate on maps, designs, uploads, bathymetry, and orders. If you use team features, you understand and agree that:
- Content marked as team-visible (maps, designs, uploaded files, depth charts, templates, brand assets) may be viewed, copied, edited, or reused by other members of that team.
- The account or organization that owns the team is responsible for its members’ activity, for managing member access and roles, and for removing members who should no longer have access.
- Team administrators may be able to view, manage, reassign, or delete content and orders created by members of their team.
- You will only add content to a team that you are permitted to share with those members.
- Removing a member, or leaving a team, does not automatically delete content that has already been shared, copied, or used by the team.
You are responsible for keeping your own account credentials secure and for all activity under your account.
Designs & Digital Products
Designs you create in the mapx editors — posters, laser-cut and CNC files, layered SVGs, and other exports — are yours, subject to the licenses of any underlying map data, fonts, icons, or third-party assets you include. You are responsible for confirming that any fonts, logos, graphics, or datasets you add are licensed for your intended use (including commercial or resale use). Exported files are provided for your own fabrication and use; reselling map data or third-party assets on their own may be restricted by their source licenses.
Marketplace Listings
If you list an item for sale, you grant mapx permission to:
- Display the listing.
- Market the listing.
- Process purchases.
- Deliver purchased digital files to customers.
- Generate previews and promotional images.
Ownership of your original work remains with you unless you expressly transfer it.
Marketplace sales are subject to a 4% platform fee plus payment processing fees, deducted from each sale.
Purchases & Payments
When you buy a digital file, a physical/laser-cut product, or a made-to-order item on mapx:
- Payments are handled by third-party payment processors; mapx does not store full payment-card details.
- Digital files are licensed to you for your stated use, not sold with a transfer of the creator’s underlying copyright unless expressly stated.
- Prices, availability, and turnaround times may change and are confirmed at checkout.
- Because custom and personalized products are made to your specifications, they may be non-refundable once production begins or a proof has been approved, except where required by law or a seller’s stated policy.
Order Proofs & Approval
For custom, personalized, and made-to-order products, mapx or the seller may provide a digital proof (a preview of your item) before production or shipping. When a proof is provided:
- You are responsible for carefully reviewing the proof — including names, dates, spelling, coordinates, place labels, dimensions, orientation, materials, and colors.
- Approving a proof authorizes production of the item as shown. Once you approve, you accept the design as depicted and are responsible for any errors present in the approved proof.
- You may request changes before approving; revisions may be subject to additional rounds, time, or fees as stated by the seller.
- Production and turnaround times generally begin only after a proof is approved, or after a stated auto-approval window passes if you do not respond.
- On-screen colors and preview renderings are approximate and may differ from the finished physical product due to materials, screens, and manufacturing.
Sonar & Mapping Contributions
If you choose to contribute sonar logs, bathymetry, GPS tracks, or hydrographic information to the Community Mapping Program, you grant mapx permission to:
- Convert the submitted data into bathymetric models and contour maps.
- Combine your data with other public or community-contributed datasets.
- Publish, improve, and distribute resulting map products.
- Sell products created from aggregated or processed mapping data, provided your individual raw upload is not redistributed unless you have opted in.
Depth Charts, Contributor Credits & Payouts
mapx lets you trace lake depth contours (“depth charts”) and choose what happens to them. You always keep ownership of what you create — the terms below describe the licence you give mapx, not a transfer of your rights.
Contributing a chart for free
If you publish a depth chart as free / public, you grant mapx a perpetual, irrevocable, worldwide, royalty-free, non-exclusive licence to host, reproduce, adapt, combine with other data, display, and distribute that chart within mapx and in maps and products made by mapx and its users. In plain terms: a free contribution stays with the system.
- It is permanent. Once published free and approved, the chart remains available in mapx even if you later delete the chart, close your account, or stop using the service. Other people’s maps and orders come to depend on that data, so it cannot be withdrawn.
- You keep your rights. The licence is non-exclusive — the contours remain yours, and you may keep using, publishing or selling them anywhere else you like.
- Attribution. mapx may show your display name as the contributor. Ask us and we will remove your name from public credit, but the data itself remains under the licence above.
- We may edit it. mapx may clean, smooth, re-project, merge or correct contributed contours for quality, and may remove a chart found to be inaccurate, unlawful, or not yours to give.
Contributor credits
- Approved free contributions may earn credits, which can be redeemed for months of a paid mapx plan. The current earning rate and redemption rate are shown in the app and may change at any time.
- Every contribution is reviewed before credits are released. Your chart may go live immediately, but credits appear only once we have checked the tracing.
- Approval is final. Credits are not reversible. Once a chart is approved and credits are issued, we do not claw them back — including if the chart is later removed, corrected, or found to be a duplicate. Equally, if a contribution is rejected, no credits are issued and that decision is at mapx’s discretion.
- Credits have no cash value. They cannot be sold, transferred between accounts, exchanged for money, or refunded, and they may expire if an account is closed.
- Credits are a thank-you for helping the community, not wages, and contributing does not make you an employee, contractor, or partner of mapx.
Selling a chart
- You may instead list a depth chart for sale and set its price, subject to any minimum. mapx retains a platform fee, disclosed at the time of listing, from each sale.
- Payouts are handled by Stripe. To be paid you must complete Stripe’s onboarding and identity checks and accept Stripe’s connected-account terms. mapx does not hold your earnings.
- You are responsible for your own taxes on money you earn, and for providing any tax information Stripe or the law requires.
- Buyers receive a licence to use the chart in their own mapx designs and products. They may not resell or redistribute the chart data itself as a standalone product.
- By listing a chart you confirm it is your own work and that you have the right to sell it. Selling data you traced from a source that forbids redistribution is a breach of these Terms.
- Refunds for paid charts are handled case by case; because chart data is delivered immediately and cannot be returned, sales are generally final.
Accuracy — not for navigation
Depth charts on mapx are contributed by users and are provided for design, decorative and general-reference purposes only. They are not nautical charts, they are not surveyed to any hydrographic standard, and they must not be used for navigation or for any decision affecting safety of life or property. Water levels, shoals and hazards change. Always use official charts and current local information when on the water. mapx makes no warranty as to the accuracy, completeness or currency of any contributed depth data.
Community & Public Content
Some features let you make content public or “share to the community” — for example publishing a depth chart, listing in the marketplace, or posting in community areas. When you choose to share content publicly, you grant mapx and other users a non-exclusive license to view, download, and use that content within mapx for its intended purpose, and you understand that public content may be copied or reused by others while it remains public. You are responsible for content you post publicly, and mapx may remove content that violates these Terms or applicable law. Making content private again does not retract copies already made while it was public.
Your Responsibilities
You represent that:
- You own or have permission to upload all submitted content.
- Your uploads do not infringe any copyright, trademark, patent, or other intellectual property rights.
- You will not upload malicious software or unlawful material.
Prohibited Uploads
You may not upload:
- Copyrighted charts or maps without permission.
- Commercial bathymetry licensed for personal use only.
- Illegal, harmful, or fraudulent content.
Data Sources
mapx may incorporate public-domain and licensed geographic datasets, including government hydrographic and topographic data. Third-party datasets remain subject to their respective licenses and attribution requirements.
Limitation of Liability
mapx is intended for map creation, artistic design, education, and visualization. It is not certified for marine navigation or safety-of-life decisions. Users are responsible for verifying information before relying on any map for navigation or other critical activities.
Account Termination
mapx may suspend or terminate accounts that violate these Terms or applicable law.
Changes
mapx may update these Terms from time to time. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms.
